Legal Notice
These general terms and conditions of sale are entered into between ARBANY HOTELS SA, whose registered office is located at 78-80 Rue du Marché, 1000 Brussels, registered with the Crossroads Bank for Enterprises under number 0682.620.474, hereinafter referred to as “the provider” or “ARBANY HOTELS SA”, and the recipient of the service, hereinafter referred to as “the client”.
The client and the provider are hereinafter collectively referred to as “the parties”.
Definitions
The following terms shall have the meaning set out below in these general conditions:
- Mobile application: A set of services and protocols enabling mobile devices to connect to the Internet and allowing the consultation and booking of hotel services provided by ARBANY HOTELS SA.
- Room: Includes rooms, duplexes, standard, superior, and premium rooms.
- Booking confirmation: The webpage or mobile app screen summarising the client’s booking, stay duration, selected services, total price including taxes, applicable terms of sale, and where the client enters their credit card details for prepayment or guarantee. Confirmation constitutes a binding agreement between the client and ARBANY HOTELS SA.
- Client: Any natural person acting for private purposes.
- Booking request: A room booking request made by the client via the website, mobile app, phone or email.
- Data: Personal data as defined by the General Data Protection Regulation (GDPR), meaning any information relating to an identified or identifiable natural person.
- Right of withdrawal: The legal period of 14 days during which the client may withdraw from a distance contract without providing a reason and without incurring any costs other than those provided by law.
- Booking confirmation email: Document summarising the client’s booking, sent by email after confirmation.
- Establishment: Properties made available by ARBANY HOTELS SA in Europe as part of its hospitality services.
- Service provider: Any individual or legal entity working with ARBANY HOTELS SA in delivering services to clients.
- Pre-authorization: A credit card validation process that temporarily blocks a certain amount, usually not exceeding one night’s stay, to be released within 10 days if unused. Conditions may vary based on the card or bank.
- Prepayment: Payment made at the time of booking for preferential rates. Non-refundable and non-cancellable.
- Privacy Policy: A document explaining how personal data is processed by ARBANY HOTELS SA.
- Group booking: Any booking of 5 or more rooms for the same period. Subject to specific terms and must be requested via group@arbanyhotels.com.
- Online booking: Room booking made via the ARBANY HOTELS SA website or mobile apps.
- No show: A reservation not cancelled by the client and for which the client fails to show up.
- Services: All services offered to the client through the ARBANY HOTELS SA website or apps.
- Website: Webpages accessible via the internet detailing information about ARBANY HOTELS SA and its services.
- Tourist tax: Regional tax owed by the client to the local authorities.
- Processing: Any operation performed on personal data including collection, storage, modification, use, or deletion.
I. General Conditions
Article 1. Application
Booking a stay at ARBANY HOTELS SA implies full knowledge and unconditional acceptance of these terms and conditions. They are presented to the client before booking confirmation and attached to the confirmation email.
These terms apply to all services unless otherwise specified in writing by authorized ARBANY HOTELS SA personnel.
Article 2. House Rules
Clients must behave responsibly and comply with internal rules. Serious or repeated misconduct will be deemed a material breach, entitling ARBANY HOTELS SA to terminate the stay without notice or refund.
Article 3. Client Responsibility
Clients are liable for any damage caused by themselves or those under their responsibility to persons, property, or hotel infrastructure.
Article 4. Security & Identification
ARBANY HOTELS SA reserves the right to request ID at any time. Clients must carry valid ID or passport.
Article 5. Guarantee
Bookings must be secured by credit card, deposit, or prepayment. ARBANY HOTELS SA may validate payment methods and perform a pre-authorization. Clients must provide accurate credit card details and present the same card at check-in.
Guarantees may also cover additional services (e.g., breakfast, parking, laundry) up to 15% of the room rate per day.
Article 6. Payment
Final payment must be completed upon check-out at the latest.
Article 7. Check-in/Check-out and Access
Check-in: from 3:00 PM
Check-out: by 11:00 AM
Access codes are shared upon booking confirmation and payment, no later than the day of arrival.
Article 8. Force Majeure
ARBANY HOTELS SA is not liable for failure to perform due to force majeure (e.g., flood, fire, terrorism, strikes). It may relocate the client within the same city.
Article 9. Pets & Smoking
Small pets allowed upon request (€20/day per pet). Damage caused will be billed.
Smoking is strictly forbidden in all areas (rooms, hallways, etc.) in accordance with the law of 22 December 2009. A €250 cleaning fee (excl. VAT) applies; higher fees may be charged for more extensive damage.
Article 10. Early Check-In / Late Check-Out Fees
- Before 10:00 AM: full night charged
- 10:00 AM to 3:00 PM: €35
- Late check-out:
- Until 4:00 PM: €35
- After 4:00 PM: full night charged
Article 11. Minors
Minors may not book rooms. Unaccompanied minors will be refused entry. Bookings may be cancelled.
Article 12. Wifi
Wifi is free. The client must comply with the network provider’s safety protocols. ARBANY HOTELS SA is not liable for unavailability.
Article 13. Complaints
Complaints must be sent by registered mail to the registered office within 10 business days of the incident, with detailed explanation. Late complaints will not be considered.
Article 14. Address Registration
Registering the hotel address as a legal residence is strictly prohibited.
Article 15. Personal Data Protection
Client data is processed by ARBANY HOTELS SA to manage bookings and may be used for marketing purposes. Data may be shared with service providers or transferred outside the EU.

Article 16. Severability
If one clause is found invalid, other clauses remain in force.
Article 17. Governing Law and Jurisdiction
These terms and the resulting contractual relations are governed exclusively by Belgian law. Only French-speaking courts of Brussels have jurisdiction.
